Fundamental Rights
* Part-IlI of the constitution (Articles 12 to 35) deals with Fundamental Rights. This part is known as the ‘Magna Cartaof lndia’.
* Part-III is also called ‘Comet Stune of the constitution`, and together with Part - IV (Directive Principles), it is known as ‘Conscience of the Constitution'
* Fundamental Rights are justiciable.

6 Rights

1. Right to Equality (Art. 14-18)
2. Right to Freedom (Art. 19-22)
3. Right against Exploitation (Art. 23 and 24)
4. Right to Freedom of Religion (Art. 25 - 28)
5. Cultural and Educational Rights (Art.29 and 30)
6. Right to Constitutional Remedies (Art.32).
* Fundamental Rights arc suspended during emergency.
* The right to property was a Fundamental Right till 1978. It was taken away through 44th constitutional amendment. lt is only a legal right now.
* Article 20 and 21 cannot be suspended even during National Emergency.
* The parliament can amend Fundamental  Rights. Article 368 empowers parliament for this.
* ‘Untouchability' is abolished through Article 17.
*Article 19 of the constitution guarantees ' 6 fundamental freedoms’. They are freedom of speech and expression, to assemble peacefully and without arms, to fomi associations or unions, to move
freely throughout the territory of lndia, to reside and settle in any part of India. to practice any profession, orto carry on any occupation, trade or business.
* Indian constituton does not provide for the freedom of press seperately. It is implicit in Article 19, which grants freedom of speech and expression.
* Article 21 (Protection of Life and Personal Liberty) become the ‘Foundation Stone' of Part- III of the constitution.
* Article 21 -A was included in the constitution through 93rd amendment. It provides free and compulsory education to all children of the age of 6 and 14.
* Article 32, the right to constitutional remedies was called by Dr. B.R.Ambedkar as ‘The Fundamental of the Fundamental Rights’ and ‘the heart and soul of the constitution’.
